Question: Can the council of owners install a tap, for the use of all residents, on my property without my approval or approval from all owners?
I’m a lot owner in a strata scheme in WA. Recently, while having a coffee with several lot owners, the subject of installing a new tap in a common property garden for residents to water their section of the garden came up. A week later, without consulting the owners, the council of owners decided to go ahead with the installation.
The plumber installed the tap on my property. The strata manager apologised for not informing me but said the council of owners isn’t required to consult with all lot owners. Is this correct?
Answer: Determining what matters require council versus all owners’ approval can be tricky.
If the area is definitely your property or exclusive use, the council of owners likely should have provided prior notice before proceeding.
However, it sounds like the water line is a common water line, which means they may very well be entitled to carry out this work without your approval.
Determining what matters require council versus all owners’ approval can be tricky, as it depends on your specific strata plan and by-laws. Reviewing these documents to understand the boundaries and decision-making authority within your scheme is a good idea.
