I came across advice that there will be new requirements for disclosure statements from August 2025. Our self-managed block sometimes gets asked for disclosure statements by owners. Will the upcoming changes affect how we supply these documents? After August 2025, will the body corporate still be able to supply disclosure statements to owners selling their lots?
Answer: The disclosure obligations are that of the seller of the lot, not the body corporate.
The disclosure obligations are that of the seller of the lot, not the body corporate. Sellers should obtain their own advice from their lawyer or real estate agent on how to prepare these, as it is not the body corporate’s obligation to do so.
Bodies corporate are often asked to provide an information certificate, which is a different obligation. There will not be a necessity for search only agents to prepare these.
