Question: Is there a timeline for the committee to approve a bathroom renovation request?
We want to renovate our bathroom, which involves removing a breeze block wall to enlarge the space. We had the wall scanned and confirmed it isn’t load-bearing, and had architect drawings prepared before submitting our request to strata management. Strata management said they would pass the drawings on to the committee for review. Nearly two months on, we’ve had no response. When we checked with committee members directly, they told us they hadn’t seen anything. What can we do? Is there a timeline for approval before we can move ahead?
Answer: Yes, six weeks, with a possible six-week extension.
Yes, there’s a timeframe. It’s six weeks. In some cases, the committee can seek a further six weeks (for example, if they need to request further information or clarification). If they don’t do that, then after the expiry of the initial six-week period and in the absence of any decision, your motion is deemed ‘not agreed to’ and that in turn is your basis to dispute this with the Commissioner’s Office. The relevant section of legislation is Body Corporate and Community Management (Standard Module) Regulation 2020, section 58 (equivalent provisions of other modules).
We’d suggest you write to the committee to say you’re aware the six-week period is up, and ask them to please clarify the status of your request. Perhaps give them 7 days to respond. That may prompt a decision. If the material and your motion haven’t even been distributed to the committee, then that’s obviously a problem. Something has been overlooked, whether by accident or on purpose, but the six weeks start from the day after your motion was submitted.
