This article answers the question – What are the legal implications of a real estate agent in strata?

Question: What are the legal implications of a real estate agent in strata? What are the OC’s responsibilities if the real estate agent manages a lot?

We are a small self managed strata of 3 townhouses. I am the secretary of our committee. A real estate manages one of the townhouses for the lot owner.

What are the legal implications of a real estate agent in strata? What is the role of a real estate agent if they manage a lot, and what are the owners corporation’s responsibilities to them? The other two townhouses are owner occupied. The real estate manager is making demands on behalf of the tenants and asking about our strata business. Should the real estate be doing this? Is this part of their role?

Answer: There are some limitations.

A real estate agent can be appointed to represent an owner regarding the management of the lease, or the owner might have them represent them in the overall management of the asset. I’ve seen real estate agents agree to act as proxies for owners and attend meetings for them. However, the law does preclude the real estate agent from being nominated for the strata committee, so there are some limitations.
