Strata water leak responsibility who locates and repairs leaks in lots and common property

By admin,

In our scheme, each apartment has an individual meter. The strata company insists that each owner is responsible for water pipes after the meter. The water bills are still calculated from a complex meter and apportioned between apartments.

The strata company maintains that owners are responsible for suspected leaks, but we all have a common interest in prompt repairs. Does the strata company have some responsibility to locate and fix the leak and then bill the responsible? Otherwise, we all suffer when there is an absent or disinterested owner.

Recurring sewer blockages in strata who is responsible and how to fund urgent repairs when funds are low

By admin,

I am an owner/occupier in a strata scheme. My unit is the closest lot to where the sewage line connects to the mains. Roots have grown into the pipes, blocking the flow of sewage. This has caused sewage from other units to overflow into my toilet, eventually getting above the toilet edge and spilling across the floor.

Every two months, the plumber clears the pipe, which will be an ongoing issue unless the pipes are replaced.

Is it illegal to reduce strata levies to attract buyers understanding NSW rules on admin and capital works funds

By admin,

I live in a block of 3 townhouses in NSW. On two occasions now our strata fees have been reduced so a particular unit can sell with lower fees to be more attractive to buyers.

Hidden water damage after purchase can archived strata records lead to legal claims for misrepresentation

By admin,

We recently purchased a top floor unit in a complex of 68 units over 9 floors. We did what we thought was our due diligence and got not one, but two strata reports and a building report before we made this purchase. There was nothing to indicate any unit had any major problems so we went ahead.

What must be included in owners corporation records and why all documents must be retained under NSW law

By admin,

I am the secretary of our Community Association. We have had a past EC member send through 600 pages of documents to our Strata Manager who has informed us they will place this on the HUB.

The problem is that this information has not been verified by the EC and we believe that this information should not be placed on the HUB until it has been verified.

Who determines what documents should form the Owners Corporation Records? Who is responsible for looking through the records to verify them?

Strata records lost during manager change legal risks and how to reconstruct missing records under NSW law

By admin,

Three years after the start of our strata, we changed strata managers. The previous strata manager provided complete records to the new manager on data file disks, but they were never incorporated with the new strata manager's records. The excuse given was that the computer systems were incompatible.

There is a three-year gap in the strata records, including details of the important decisions taken in the original days of the strata. Does this impose any legal liability on our Owners Corporation or its strata committee? What steps should be taken to rectify this problem?

Resolving voting deadlocks in strata BMCs when levy contributions and voting rights are misaligned

By admin,

We live in a 20-year-old multi-purpose building consisting of a tavern, hotel accommodation, short-term tourist apartments and residential apartments. There are 4 strata schemes that make up the Building Management Committee (BMC) governed by a BMC statement. The BMC voting rights are 1 vote for each Strata, however, the residential strata pay the majority of the building costs as per the BMC statement 'Relative portion of each strata lot'.
