What's the difference between a strata scheme and a community scheme in South Australia?
Older schemes, mostly set up before 2009, run under the Strata Titles Act 1988. The Community Titles Act 1996 has been in force since 1996 and covers all new schemes from 1 June 2009, including larger or staged developments.
If you're not sure which Act your scheme is under, check your title. It will say strata plan or community plan, which tells you which Act applies, which regulator process you're dealing with, and which forms you'll need.
What's happening to strata in South Australia?
Both Acts have been amended following the Statutes Amendment (Community and Strata Titles) Bill 2024. The changes raise the minimum public liability insurance from AU$10 million to AU$20 million, extend maintenance planning from five to 10 years, make it easier to reach quorum, and tighten how strata managers disclose commissions and benefits. New Community Titles Regulations commenced on 1 September 2026, replacing the 2011 Regulations.
