Is a BCCM Form 20 Required for a New Management Rights Agreement?

By Neziah,

Our Community Title Scheme is under the Accommodation Module. The original Caretaking and Letting Agreement is in place from the developer and there have been several changes in Caretakers since, as well as some minor variations to the agreement with some of these being time extensions.

The Caretaker has put forward a motion requesting a full 25 years renewal and for the current agreement to be contemporaneously replaced by this new proposed agreement.

Does the Strata Council Have to Intervene in Disputes with the Strata Manager?

By Neziah,

If an owner has an issue with the way the Strata Management company is dealing with a dispute does the COO have to step in to try to resolve it when approached? If so, what section in the Strata Titles act refers to this? Is it not the role of the COO to act in the interest of the owners?

Who can vote on changes to the minutes of the last meeting?

By Neziah,

In my view, our last AGM was fraught with irregularities. It was held in December, 17 months after the previous AGM, and I believe the voting process was flawed, among other issues. Because of the festive season and the delay in convening the first council meeting, the council was slow to respond to the strata manager about approving the minutes. The strata manager distributed the minutes without approval.

Are owners who volunteer their expertise covered by body corporate insurance

By Neziah,

Our body corporate committee includes two people with engineering qualifications. They help when we get quotes for maintenance work. They understand the issues, can prepare a scope of works and can supervise the work. As committee members, they are covered by our public liability and office bearers' liability insurance policies.

We also have owners with relevant qualifications, such as building, project management and engineering. These owners have offered their help and advice. We've been told our policies don't cover them. Is there anything we can do about this?
