Our strata manager has repeatedly failed to register our house rules — can I serve them with a contract breach notice?

By admin,

Our strata manager failed to register our house rules after our AGM. We brought them forward to the following AGM with some additions, and they were passed by the owners corporation again.

It has been approximately three months since our AGM and the rules have not been registered. We’ve served the strata manager notice that their tenure will not be extended after contract expiry.

As chair, can I serve the strata manager with a contract breach notice before the end of the contract?

Can a strata committee limit a member's participation before removing them?

By admin,

In our over-55s strata, a committee member has behaved so badly that the remaining members no longer wish to deal with them.

Can the executive committee hold meetings without this member? Can we conduct voting by paper so that we avoid personal contact until we can hold a General Meeting to remove them?

Can a committee member whose proxy expired still stay on the owners corporation committee?

By admin,

The chairperson of our owners corporation is on the committee because they have been a proxy since our last AGM. We had our previous AGM 14 months ago.

If the proxy was not renewed 12 months after the last AGM, the chair’s proxy expired 2 months ago.

Can a committee member whose proxy expired still stay on the committee?

Purchasing Common Property - What do I need to do?

By admin,

There are three units in our strata. Behind my unit is a small plot of vacant common property that was likely a guest car park at some point but has never been used.

I would like to buy this common property so I can extend my fence and create a backyard. The other two owners are open to this, although another consideration is the land could be subdivided and sold externally to build a new house.

How do I measure, value and purchase this plot of common property?

Maintenance costs are rising in our ageing building — the COO will not distribute my redevelopment plans to owners. How can I ensure they get access to this option?

By admin,

Owners in our ageing 1970s strata building on the Perth foreshore are concerned about the rising maintenance costs.

I contacted a well-known architect who designed a beautiful new Plan of Complex, from our old two-story into a five-story building.

The project will be funded by the pre-sale of stories 3 - 5. Each owner will receive a new apartment.

I have submitted the plans to the council of owners, but the council refuses to pass this on to all owners. They are split 50/50 on the redevelopment. Are they required to pass the information on to owners?

Our strata manager has not called a strata meeting for 15 months — are there any valid reasons for a late AGM?

By admin,

Our strata manager has not called a strata meeting for the last 15 months. Are there any valid reasons for a late AGM? How about works being undertaken on common property, such as pool renovation and painting, or one council member being away? What action can we take to get things back on track?

When the embedded network provider increases rates, how can the strata accept the increase on residents' behalf?

By admin,

What is the process with electricity tariffs when the embedded network provider wants to increase prices that are unacceptable to the owners corporation? When rates increase, how can the strata, who are not the end-paying residents, accept the increase on residents' behalf?

Do We Need To Supply Our Tenant's Details to Strata?

By admin,

I own a unit in a block of 8. It is tenanted to a responsible tenant with two children.

The next door neighbour (treasurer) is very intimidating and always complaining. He has requested the Surname and phone number of my tenant. I believe this is a breach of her privacy. The Strata Title Committee has my private details, and also the Estate Agent who manages the rental.

Am I obliged to provide my tenants details to strata or the committee, given that the Strata Committee has adequate contact details for myself and the agent?
