Opportunity cost of delaying strata repairs

By admin,

What is the potential opportunity cost of delaying special levy funded essential strata repairs? How does the timing of the expenditure financed by a special levy now compare to the later impact the potential for claiming these deductions by individual owners or the overall financial health of the scheme?

Owners corporation responsibility to provide disability access

By admin,

My husband and I are owner/occupiers in a 300+ unit building. My husband is bilaterally upper limb disabled (hands, wrists, fingers, forearms).

We have requested a self-opening door into our garage level. The owners corporation committee has denied the request, and we were told we “should have chosen a more appropriate location to live”. Is the owners corporation responsible for installing a disability auto door for access to the garage/vehicle?

When a roof leak only damages one unit, is the body corporate responsible for repairs and insurance excess?

By admin,

I live in a top-floor unit and recently experienced water damage from a weather event, with water entering through the roof. I'm the only unit affected, but the body corporate refuses to cover the repair costs.

Can a building management committee be brought under the strata plan?

By admin,

Our building has a building management committee (BMC). The strata plan runs the residential, and a BMC runs all associated services in accordance with the management plan.

Our strata manager said the BMC can be terminated, and the associated services can be bought under the strata plan. Is this legally possible? If so, would the cost of making these changes be viable?

Are we required to prepare and practice an evacuation plan?

By admin,

Our strata village has a new operator. The previous operator prepared an evacuation plan for the village and practised it twice a year. The new operator asserts that as village residents live in independent units, in NSW they are not legally required to prepare and practice an evacuation plan. The Act seems to indicate they DO have an obligation for an evacuation plan. What is the legal position?

Fence replacement costs in a townhouse complex

By admin,

We live in a large Class B townhouse complex in the ACT with 185 lots.

After 20 years, the picket-type fences separating the townhouses from the common property need replacing. The total length will be about 1.5 kilometres and no small cost. The cost of replacing the fences will be shared between lot owners and the owners corporation. Further, not all owners are affected equally, as some fences are longer than others.

Should I receive a receipt for my levy payment?

By admin,

Are strata managers required to issue receipts for payments made by lot owners? My water and gas usage is never over $50, but my strata fees average $1800 per quarter. I have never received a receipt. When I inquired why, I was told it would not be cost-effective. I can log into our strata portal, but this only shows me one transaction.
