Are Adaptable Parking Spaces in Basements Safe and Compliant?

By admin,

In our basement there are a total of 12 adaptable unit car parking spaces and 3 of the adaptable car parking spaces are situated on a corner.

The shared zones open onto the traffic side of these spaces. These spaces do not display the international symbols nor is there a bollard on the shared zone.

When I raised concerns with our strata management, they don’t seem to know much about the situation only that it's been certified. People park on these shared zones as the signage is confusing.

Is Visitor and Disability Parking Mandatory in New Apartment Buildings?

By admin,

Our apartment building of 58 apartments has no provision for visitor parking or disability parking. The building is only 2 years old.

I think this is not legal, and that the developer has just ignored the requirements. He has also kept a very disproportionate amount of parking for himself.

What action can be taken to remedy this and to hold the developer to account?

Does an owner need permission before installing parking bollards?

By admin,

Our apartment building is part owner residents, part rented apartments and ten hotel apartments. The hotel lot owner has eight car spaces, which include our two disability parking spaces. This owner has recently installed bollards into all eight car spaces. Are the lot owner car spaces common property, and should they have submitted a special resolution at a General Meeting to be approved before the installation? Can this lot owner restrict disabled parking to hotel guests, or can other disabled visitors use these parks as well?

How and When Are Office Bearers Appointed to a Council of Owners?

By admin,

We have Strata Manager. We have just elected a council of owners but we have not yet appointed office bearers.

One of the members wants to convene a meeting in 5 days time without the strata manager being there. She wants to appoint office bearers then but there may be some contention between members. Is this meeting valid and allowed under the act? If decisions are made that affect the strata as a whole are these valid and can they be upheld?
