Does an owners corporation manager have to recommend a maintenance plan

By admin,

Our owners corporation manager has managed our property for years and never suggested the need or benefit of a maintenance plan. Why is this, and does the owners corporation manager have a responsibility to raise the need for a maintenance plan with the committee?

Committee member withholding common property access keys

By admin,

We have a committee member who refuses to hand over access keys for our block’s common property. We currently have no access to the stairwell, roof hatch, power board or smart meters. The issue stems from a dispute between the committee member and another owner.

The committee has largely been unresponsive. What are our rights, and what can we do to get access restored?

Can an owners corporation on-charge a lot owner for security reprogramming

By admin,

One of our lot owners had their building access fob and keys stolen from their unlocked car in our private car park. The owners corporation (OC) decided to on-charge the lot owner for reprogramming building access for every resident, real estate agent, and owners corporation manager. Our standalone security system won't allow an individual lot to be wiped, though it's being upgraded soon.

Who is liable for non-compliant building work in a strata scheme?

By admin,

There are four double-storey units in our complex of 10. In 2017, we replaced the balustrades on the building. A new owner had a building inspection done and discovered the work doesn't meet Australian Standards. The balustrades are 5cm short of the required height.

Why do some strata schemes delay levy debt recovery actions?

By admin,

In our residential building of 6 units, one lot owner has been overseas for more than a year and hasn't made a levy payment for that duration. Strata have said they are in debt recovery and going through the courts.

Why hasn't strata acted much sooner and how long can this go on before its resolved? I would have thought after 3 months of no levy payments and strata would issue a debt recovery action letter to the owner.

Strata levy debt recovery process: Steps to take when an owner refuses to pay

By admin,

I am the “Honorary Administrator” of a self-managing strata scheme of four townhouses.

We may need to take levy recovery action against one owner who is refusing to pay the 4 equal quarterly levy contributions discussed and agreed to as an agenda item at our AGM.

I have sent several friendly reminders and a formal letter of demand to pay by 4 equal quarterly instalments as required under the NSW Strata Schemes Management Act and the Owners Corporation, but he is refusing.
