Can strata levies be revised mid-year and applied retrospectively?

By admin,

Can strata levies be revised partway through the year, before the next AGM and the next year's budget? If so, can they be revised with retrospective application?

Obviously, it's standard to set levies once a year and then raise special levies as required. This is not about special levies. We are interested in revising (increasing) standard levies for the current period, hopefully with retrospective application (that is, for the entire current period, from the beginning).

Are owners unfinancial if a special levy is unpaid before it is repealed?

By admin,

Our large strata complex needs to raise a $1 mill special levy to carry out remedial water ingress repairs. After reviewing all documents sent by the strata management company and remedial engineer, there are issues with the quotation.

We need to call an EGM to repeal the special levy. The strata manager delayed sending the documentation, and the invoice is due in a few days. Will owners lose their voting power if they have not paid their special levy?

Special levy refund: Current or previous owner?

By admin,

Our owners corporation raised a special levy to renovate common property. The work was cancelled. At the EGM, it was decided that the levy amount would be refunded to each lot owner. Over this period, a lot was sold. Can the new owner of that lot claim the refund, or does the money go to the previous owner?

Can special levy funds be moved between the admin and capital works funds?

By admin,

A special levy of $110,000 was raised four years ago and deposited into the administrative fund. In the first two years, $80,000 of that levy was spent from the administrative fund. In the third year, $15,000 was spent from the capital works fund for expenses related to the special levy.
