Garbage bins are located in the complex's sole visitor parking space. Can the OC request that residents keep their bins inside their garages, especially when there are no alternative storage options?

The owners corporation agreed the property's garbage bins would be placed in the complex's only visitor parking lot. One owner, who would like access to the visitor parking space, requests that bins be stored on private property (either in the home or garage). Can owners be asked to place their bins in their garage? There are no other accessible lot spaces available for storing the bins.

The visitor car park should be used for its intended purpose.

It may not be legal for the owners corporation to use the visitor car park for garbage storage, as the visitor car park should be used for its intended purpose. The requirement for a visitor car park may be a condition of development consent for the building. Any change of use will most likely require an application to modify the DA. Similarly, without a by-law regulating the placement of Council bins, the demand to keep your bin on your property may not be enforceable.
