Strata parking problems in owners corporations

By admin,

Someone has been parking in my personal car park spaces for over a month. Our Building Manager will not assist as he states it's not his job because my car spaces are private property as opposed to visitor parking spaces that are common property.

Should the building Manager be assisting me? If this isn't his job, who can help? What can I do to stop this person from parking in my space?

Is Living in a Garage Illegal? How Can We Stop This?

By admin,

Can we establish a by-law that restricts the use of the garage to the parking of cars?

Our strata block has garages between each villa. The villa's garage adjoins the next villa's bedrooms. All noise in the garage area can be heard in the bedrooms.

A resident uses their garage as an extra entertainment room with lounges, a coal-burning BBQ, TV, etc. The noise from this garage space disturbs the surrounding residents with smoke, smell, and noise.

Can we establish a by-law that restricts the use of the garage to the parking of cars?

Who sets the agenda, Explanatory notes [including an AGM Agenda Template]

By admin,

Our strata manager added a new motion to the AGM agenda after the notice had already been sent to owners, claiming the agenda had to be revised anyway to include updated financials. They argued this allowed the addition of the late motion. Is the secretary permitted to add late motions in this way?

Lot Owner's Overdue Strata Levies. What are the rules?

By admin,

In WA, what disqualifies an owner from voting at a general meeting? Levy arrears are a given, but what about utility charges for an embedded system charged out via the strata managers?

In essence, is the right to vote dependent solely on levy arrears? If not, what other charges can disqualify an owner from eligibility to vote?

Safety Hazards and Risk in a Body Corporate

By admin,

I am the chair/secretary of our body corporate committee. In our basement car park, we have six ventilation louvres. An owner’s car space is directly under one of the vents. They own a Tesla car and have asked if they can block off the vents.

The building is beachside, and salt air is a factor. Alternatively, the owner suggested placing a protective roof over the vehicle. We are concerned that both suggestions interfere with the design of the ventilation system. Is this correct?

Approval for Renovations / Changing Appearance of the Lot

By admin,

We'd like to install some skylights in our apartment in Victoria. The roof of the building is common property.

I sent the renovation form to our owners corporation (OC) manager, agreeing among other requirements that:

"We accept liability for any costs associated with damage to common areas by the contractor and charged to the lot owner, and we accept liability for any damage/ water leaks caused or as a result of the renovation work".

We also confirmed after double checking with the contractor that the works will not compromise the roof structure.
