Electing office bearers at the AGM or executive committee meeting

By admin,

Does the legislation require lot owners to vote on the appointment or reappointment of office holders, such as the chair, secretary and treasurer, at every annual general meeting? Or can the strata committee instead elect or confirm these office bearers at its first committee meeting after the AGM?

Counting votes and attendance when one owner has more than one lot

By admin,

At our strata AGM, the attendance and voting were recorded as 17. One company owns three units, and the company representative attended the meeting. They were recorded as holding three proxies (one for each lot) and were counted as “3” in the attendance and voting total.

Is it correct or fair for a single company representative to be counted as three for attendance and voting purposes simply because the company owns three lots?

Who pays when rooftop air conditioners must be moved for roof works

By admin,

The body corporate is undertaking significant roof maintenance that involves removing and replacing sections of the roof sheeting. Three owners have air conditioner condensers in the affected roof areas, and these units need to be temporarily removed so work can proceed.

Are the owners responsible for paying the costs of removing and reinstating their condensers, or should the body corporate cover these costs as part of the roof project? One owner has three condensers and has been quoted around $6,000, which feels like a lot to absorb personally.

Are Caretakers Obliged to Share Former Tenant Contacts for Abandoned Vehicle Issues?

By admin,

The building caretaker refuses to provide the phone number and email address of a previous tenant who left their car on the body corporate premises. The bylaws clearly state that the car can be towed. The committee wants to contact the car owner to allow them to remove the vehicle before it's towed. Can the building caretaker refuse to provide the information?

Can We Tow for Ongoing Visitor Parking Misuse Without a Magistrate’s Order?

By admin,

Four new owners in our complex each have a second car, and they regularly park in the visitor parking spaces. As a result, when our family or friends visit, there are no available parks. The body corporate has repeatedly advised these owners that parking in visitor spaces breaches our by-laws, but the issue continues.

Should caretaker hours cover weekends and peak letting periods?

By admin,

Like many older management agreements, ours only requires the onsite manager to “be available” for a short block on Saturday mornings. However, our peak guest periods are from Friday afternoon through to Sunday morning, as well as during school holidays. There is also a growing trend for onsite managers to live off site, which means they are often not around during busy times.
