Who Enforces Council Rules on Short-Term Accommodation in Strata?

By admin,

Several units in our scheme have applied to Brisbane City Council for their unit's DA to be changed to short-term accommodation.

The council granted the DA change, stipulating that the units must now be used for STA only. However, not all units that changed their DA are being used for STA. Some rent long-term and some are owner-occupied, which breaches council DA regulations.

Can a Body Corporate Enter Your Lot for Fire Safety Checks?

By admin,

As a lot owner, we've been informed that fire safety checks will be carried out in our building on a particular day. We cannot refuse entry to our apartment or change the date or time. They will knock before entering but will enter, whether we are at home or not.

Most owners were surprised to find that the body corporate has keys and supposedly the right to access our properties without our permission when we are away. Is this legal?

Why Holiday Let Owners May Not Hold Their Own Unit Keys

By admin,

We have an apartment in Noosa in a block of 25 units. The onsite managers manage the holiday let of our unit and we holiday in the lot every Christmas. The onsite managers have informed us that, in future, we will not have access to a set of keys to our own unit! All keys must be kept in their key safe and we need to ask for access when we arrive. They claim it is now legislation. Is this correct?

Can You Retile Over Existing Balcony Tiles in Strata?

By admin,

I have a tiled balcony that is on top of the living area of the unit downstairs.

I am wanting to get the balcony retiled. The tiler has suggested we tile on top of the existing tiles and re-waterproofing.

My neighbour below wants me to get acoustic underlay. This will effectively double the price. Do I have to do this as the area is already tiled and I am not changing the material? My tiler has informed me that adding waterproofing and new tile will improve the acoustics from what they are anyway.

When Acoustic Flooring Standards Can’t Be Met in Strata

By admin,

My by-laws state I am required to achieve an AAAC star rating of 5 if installing floorboards. After conducting almost 30 different acoustic tests, engaging 2 acoustic consultants and speaking to 11 other acoustic consultants, we have not been able to find a product (flooring and underlay) that achieves a rating of 5. A rating of 4 is the best I can achieve.

Noisy Flooring and Neighbour Disputes in Strata Apartments

By admin,

I have an annoying neighbour upstairs who is constantly banging on his floor and yelling at me if I make any noise.

His apartment has floorboards instead of the carpets. He is the one with noisy flooring, yet he constantly complains about me.

I can hear every noise from his unit, including his footsteps.

What can I do to solve this situation?
