Can a strata committee make common property parking legal against by-laws and development approval requirements?

By admin,

The strata committee has conducted an online survey with all residents to ask them if they want parking bylaws to be enforced. If the majority of residents in a strata scheme vote against bylaw enforcement in the common area, can the strata committee make parking in common area legal?

What happens to the residents who are affected by others parking on common property? I'm concerned about blocked strata footpaths, internal strata road obstructions, accidents or mishaps occurring due to the relaxing of parking rules.

Can strata schemes change visitor parking to resident use or impose time and access restrictions?

By admin,

In a Strata complex with 8 Villas. We have 2 council approved Visitor Parking spaces.

Can we:

  2. put a time limit on the visitor's parking spots?
  3. say no visitors cars on premises after 9 pm?

Can visitor parking be converted to private car spaces in strata without breaching development consent?

By admin,

Our strata manager has informed us that we can convert our visitor car park into a unit car space without having to comply with our development consent.

We are atm complying with the minimum 13 visitor car park spaces as per Strathfield council development consent (1 visitor space per 5 units) but if we convert one of them, we will be going against the development consent.

Can a strata scheme clamp a frequent visitor’s car for overnight parking without consent?

By admin,

I stay overnight a few times a week at a friend's apartment. If there is no street parking, I park in visitor parking. There are no signs up stating the time frame etc for visitors.

I have been getting handwritten notes left on my windscreen threatening removal or clamping of my vehicle. What are my rights as a visitor? Can the owners corporation clamp my car?

Locking common doors without owner consultation in NSW

By admin,

Our strata scheme locked common doors that have never been locked before. The only communication we got was that we needed to collect keys.

The lack of notice has created real problems. Delivery drivers can't get in, so parcels are redirected to the post office, and we have to take time off work to collect them. Posties don't always leave cards, so we don't always know something is waiting. The strata committee expects us to be home for all deliveries.

Installing CCTV on common property without owner approval in NSW

By admin,

We are in a 12-lot NSW strata scheme. The strata committee has not held compliant strata committee meetings for several years and has made decisions in undocumented meetings. Owners then receive special levies for major capital works, including a recent proposal of around $1 million, without clear records or committee minutes.

What can you do when a builder avoids defect repairs and changes ABN?

By admin,

Our building is 4 years old. The committee has already taken the builder to QBCC regarding fire, waterproofing and roofing defects and the builder chose to fix some of the DTRs and then opted to take the $2500 fine and 4 demerit points rather than address the $100k plus costs associated with rectifying the remaining issues. The builder and developer still own 6 of the 24 units, and successfully voted down a motion at our AGM to take the builder to QCAT to recoup the $40K spent getting our building compliant.
