Do developers need to disclose NDIS apartments in strata buildings and what rights do owners have over security and common areas

By admin,

I live in a 51-apartment building in Perth with 8 NDIS-allocated apartments. Owners are concerned that they were not informed of this prior to purchasing. Should this have been disclosed?

People who we assume are carers come and go without ID which makes security an issue. They also use the residents’ lounge, office and pool without being accompanied by a resident. Should they be wearing an ID? Should they be using the residents’ common areas? We have spoken to the company responsible for these apartments, but the issues continue.

What by laws apply to survey strata properties with no common property in Western Australia

By admin,

I am considering purchasing a strata property in Kalgoorlie in a four-building strata plan. The four properties are separate buildings with no common walls. Each unit is on its own fenced block. There are no common areas.

The four properties are currently owned by the development group. No strata management company has been set up. When they are sold and owned by different individuals, what by-laws and other requirements would the new owners need to adhere to?

Do community websites meet noticeboard requirements for committee meeting notices under BUGTA

By admin,

Our Committee never displays the Notices of pending Committee meetings on our notice board. This failure to display such notices has been occurring for many years.

Does the use of a “community” website whereby Notices for pending Committee meetings are published satisfy the legislated obligation to display such notices on our common property notice board?

Can a body corporate move a noticeboard and does it require committee approval or a vote

By admin,

We live in a strata complex of 32 units commercial/residential mix. We have a notice board next to the building's main front entrance with papers attached showing pool registration, contact listing and lift approval some going back to 2016 which looks quite messy.

We think these notes could be moved to a different lobby that is frequented less by visitors to improve the appearance of the main front entrance.

Can we move the notice board somewhere else? What would the process be to conduct this? Do we need to have a meeting and vote, or can we simply just move the board?

Is an online noticeboard via a strata portal a valid method for displaying committee meeting notices

By admin,

The BCCM legislation permits, but does not require, a scheme to maintain a noticeboard in a suitable position on common property. This noticeboard can be for the display of notices and other material of interest to the owners or occupiers. If they do maintain a noticeboard, notices of proposed committee meetings must be placed on it. Is an online noticeboard, accessible only via the BCM’s portal, a valid noticeboard?

Are owners corporation audits mandatory in the ACT and how is the $250000 threshold calculated

By admin,

We are a complex of 17 units. Are audits of the owners corporation financial statements legally required in the ACT? Our treasurer and strata manager are at odds with what elements are considered to reach the $250,000 threshold.

The strata manager advised that our total assets (sinking and admin fund) plus the proposed owner levies for the coming year are the basis for assessing if we reach the $250,000 threshold. Our treasurer believes it is the proposed budget only (and not other assets already held and not proposed to be spent).

Can hosing balconies into lower courtyards be a strata nuisance under Queensland law and how can it be stopped

By admin,

We live in a ground floor apartment in a block of 12. The front and side balconies above us have over the edge drainage which drains directly into our courtyard and swimming pool. Is it acceptable for the apartments above us to hose their balconies and balustrades into our courtyard and pool?

Each time this occurs it takes hours to clean all the dirt from 6 floors above as our drainage is 100mm floor wastes. It also takes endless time cleaning and re-balancing the chemicals in our pool.

Can this be stopped?

Is throwing objects from balconies an offence under queensland strata law or a by law breach?

By admin,

We regularly have residents throwing objects from their balconies, including soft drink cans, water bottles and cigarette butts. These objects become a safety hazard for people below, who may be struck by these objects.

Is there legislation in Queensland which makes such behaviour an offence?

How to handle ongoing noise complaints and intimidation from a neighbour in a Queensland strata scheme

By admin,

How do we deal with an intimidating bully? We are relatively new owner/residents in a tower block in QLD – 7 apartments per floor. The neighbour’s door is very close to ours at one end of the corridor. He has been renting his place for several years and works from home. We are semi-retired and also work from home.

Our neighbour rises and begins making noise from 4.30 am every day. We are woken by loud kitchen noises, the garbage disposal unit and his dog barking loudly. These noises continue throughout the day.

Falling objects from balconies in strata schemes what can residents do when safety risks persist

By admin,

I live in a 17 floor apartment regulated under the Standard Module. The unit I own is on a podium level which has an extended courtyard area, as do all units on this floor. Over the months, all podium residents have had things fall or be thrown onto our courtyard, including cigarettes, glass, dirt, oil, food, animal faeces, bottles of beer/wine, a floor lamp and a paint can.
