An owner in our NSW community title property sub-lets the entire home as an AirBnB. We have issues with nuisance. Where do we stand?

I am the secretary of a NSW community title property. Someone from out of the state owns one home. They sub-lets the entire home as an AirBnB.

We are having issues with noise, use of common property (pool, BBQs), etc. I'm aware that under strata title, a by-law can be created to address this behaviour, but I can't find anything of that kind for our community title complex.

Where do we stand? Do we have options, or are we stuck in a situation where the by-laws are continuously breached?

Your Community Management Statement should address this.

You will have a Community Management Statement, which likely regulates matters such as AirBnB, noise, nuisance, etc. You should check that document. However, in case your concerns are not addressed, amendments to the CMS may be made with the approval of the Community Association.
