My rented apartment is next to a resident facility room. I'm regularly disturbed by noise. The building manager has installed signs to limit the noise, but no one has noticed. What can I do?

I rent in an apartment block that has a grand hall room facility for use by the residents. The facility room is situated right next to my apartment. Moving in, I knew this was the case, although the noise is getting out of control. The by-laws state that occupants must be out of the room by 10:00 pm but this rarely happens. I'm forever knocking on the door, asking them to keep the noise down and / or leave the room. In addition, it's noisy at other times when residents are setting up for events and moving furniture around the room.

My real estate agent has raised my concerns with the building manager who has installed signs, but no one complies. I've booked the facility every Friday and Saturday for the next month because I feel I have no other option. What do I do?

You need to ascertain that the registered rules state time limits for the room use.

One of your difficulties is that, as a tenant, you will need to go through your letting agent to take the matter up with the owners corporation. You need to check the rules to determine the legal requirements for this hall's hours and usage. I note you say the by-laws state times, but you need to ascertain that the registered rules also state this. In the ACT, they are called rules and not by-laws.

One solution may be for the owner's corporation to install timed lights that switch off at the noted times. You could also request that the owners corporation put stoppers on the furniture.
