Who is responsible for repairing and maintaining the original timber floor in a heritage commercial strata building?
In the ACT, who is responsible for repairing and maintaining the original timber floor constructed on original timber joists and bearers on the ground floor in a heritage commercial strata building?
I assume the timber floor is part of the original building structure. Is it the lot owner or the owners corporation’s responsibility?
This would depend on whether it is Class A or Class B.
This would depend on whether it is Class A or Class B. For the purpose of this question, we will presume Class A and that there were no additional rules registered to determine responsibility.
The boundary of a Class A unit is midway between the walls, floors and ceilings.
Everything outside that central line is common property. It would also be advisable to obtain an engineer’s report.
Responsibility for Repair and Maintenance
The owners corporation is responsible for the repair and maintenance of common property.
The owners corporation is also responsible for the repair and maintenance of load bearing structures and balconies in Class A developments.
Unit owners are responsible for the repair and maintenance of their units.
