Can a lot owner access strata financials after leaving the council?

By Neziah,

After several years as chairperson of our council of owners, I recently resigned due to family health matters. Until a few days ago, I could view our daily financial statement through an online portal, along with several documents and invoices for our unit.

Our strata manager says that I no longer have access to the statement of financial affairs because I am no longer a strata council member.

Are strata companies responsible for injuries from common property trees?

By Neziah,

Our estate is a large single-storey survey strata with no direct employees. It is located in a Shire Tree Preservation Zone. Marri trees on the estate's common property drop lots of honky nuts. Several people have fallen and sustained injuries.

Is the strata company required to provide a safe environment for contractors, volunteers, residents and visitors?

Do owners need to agree to a slight colour change?

By Neziah,

Our strata company presented a colour scheme at the AGM that has slight variations from our current paint colours. Due to the colour change, does the strata company need to send a circular resolution through the strata manager for owners' approval? Or is there a quicker, easier way to get approval, such as an email to all owners?

What are the insurance options for survey strata owners?

By Neziah,

We own 1 lot in a duplex of seven duplexes built around 2000. Each duplex has a common wall between the two lots. Four of the duplexes are two-storey.

Our strata manager informed us that, because we are survey strata, we can no longer be jointly insured and each owner will need separate property insurance.

We are getting the common areas valued so that the strata manager can get quotes for insuring just the common areas.

If a contractor damages our retaining wall, who is liable, and will insurance cover it?

By Neziah,

We have 6 units and 5 committee members. Four committee members engaged a contractor to fix barge boards and eaves. I was advised the contractor would use a scissor lift at the southern end of the building, but they went to the rear instead, placed the lift on the retaining wall, and cracked it in five sections.

Unauthorised legal costs and unfinancial status in a small body corporate

By Neziah,

We have four owners, one treasurer and one secretary. Special levies for a legal matter far exceeded our lawyers' original estimate, and further legal work had been carried out without authorisation. We sent a formal letter requesting copies of the invoices, but none were provided, and the timeline has expired.

Do I still have to pay body corporate levies while a levy dispute is being resolved?

By Neziah,

A body corporate manager (BCM) was appointed as administrator for our community titles scheme and directed to hold an AGM. Before that AGM, the BCM issued a levy notice that wasn't part of their appointment. The BCM is now claiming I'm in arrears from before the AGM was even held, but I've never received a valid invoice.

Does the body corporate have to install a common antenna for the MATV system?

By Neziah,

Our unit complex of 6 units has built-in infrastructure for free-to-air TV signal distribution, with TV signal sockets in every unit. I believe this is called an MATV system. Currently, there is no antenna supplying a signal to these. When I raised this, the body corporate manager and committee advised that it is each lot owner's responsibility and cost to install an antenna on the roof.
