Does a strata plan or a common property memorandum take precedence?
My lot leads onto an open roof area in our building. Who is responsible for the waterproof membrane in this space? The reading of a note on the strata plan suggests that it is part of the lot, but the common property memorandum attached to the by-laws says it is common property. Which document is correct?
What information is a committee required to pass on to lot owners?
I am not part of the committee and missed the last AGM (more than 15 months ago) due to work commitments. Since then, I have received no information about the property despite several major special levies and improvement works. These were not part of the minutes from the AGM.
When I questioned this, I was told I'd given up my right to information when I didn't attend the meeting. I thought I'd given up the right to vote, not the right to information.

We have an NCAT compulsory appointed strata manager. The lot owners do not receive any financial reports with regard to the income and expenditure of our strata scheme e.g. monthly reconciliation reports or reports under regulation 41 of the Property Stock Agents Regulation 2022. Is this legal?

I am a 78 yr old female. I have a three wheel bike. Our vehicular exit to the road is a steep incline, and difficult for me to push my bike on. The bike is heavy, but I am ok on the flat ground.
I am thinking of asking our Body Corporate if I can bring my bike through the door from the garage to the lift, go up one floor to the main entrance and exit on a slightly downhill pathway.
Is this a reasonable request? Could they refuse?

In a unit block of 4, there are two downstairs ground floor units and two top floor units. I am the owner-occupier of a top floor unit. All the units have an exclusive use courtyard.
My water stop valve is in the courtyard of the ground floor unit and the owners have put a lock on their gate apparently with the blessing of Body Corp Management.

My Body Corporate committee wants to lock the building front entrance overnight. Does the committee have the power to restrict access to common property? Can an EGM vote deny owners access to their common property entrance during these vulnerable hours of the night?
