Question: Is the owner or the owners corporation responsible for soil subsiding in the backyard of a lot?

In the backyard of one lot, the soil has subsided and exposed steel rods that were embedded below the soil between the boundary wall and the external unit walls. These rods were probably inserted as anchor rods when the complex was built. Is the owner or owners corporation responsible for replenishing the soil so that the backyard doesn’t become a trip hazard?

Answer: Refer to an engineer to review and advise further.

I suggest the owners should have an engineer look at it as the subsidence if severe may need to be addressed.

Furthermore, unless those steel rods are ground anchors, I suggest they shouldn’t be exposed if they form any structural consideration, so again, they should refer to an engineer to advise further. With sufficient photos plus any original plans of the site it would probably be a desktop review to be safe.
