NSW: After Magnesite Removal, Must the Owners Corporation Relevel Floors With Self-Levelling Cement?

Question: When the owners corporation takes up magnesite as required by the by-laws, are they obliged to replace it with self-levelling cement to provide a level surface for floor coverings?

Answer: If magnesite removal does not impact the structure, the floor should be reinstated to an equivalent finish. Structural damage would require engineering and planning approvals.

This would rely on the extent of the magnesite and associated damage to the slabs etc. If only removal and replacement are required, without any subsequent impact on the concrete and reinforcement, then it would be assumed that an equivalent finish would be reinstated as part of the works. It is assumed that an engineer’s specification would be provided detailing such works, irrespective.

If there is more substantial damage, you would need structural engineering designs, including, where appropriate, regulated designs. Finally, if undertaking structural works, you would also need to verify what planning consent is required for the finalised scope of works.
